CHARLESTON, W.Va. (AP) – A Kanawha County judge has ordered an Internet payday lender whose owner is affiliated with an American Indian tribe to comply with a state subpoena for its records.

State Attorney General's Darrell McGraw's office says Circuit Judge Duke Bloom ruled recently that Payday Financial LLC isn't protected by tribal immunity.

Payday Financial conducted business as Lakota Cash and is owned by Martin A. Webb, who is an enrolled member of the Cheyenne River Sioux Tribe. The attorney general's office sued Payday Financial and Webb after they refused to comply with the subpoena.

McGraw's office began receiving complaints last year that consumers had obtained Internet payday loans from Payday Financial. Such loans typically have very high interest rates and are illegal in West Virginia.
