WINDOW ROCK, Ariz. (AP) – The wife of a Navajo Nation lawmaker has been released from tribal jail after spending a week behind bars for failing to answer questions about a discretionary fund.

Window Rock District Court Judge Carol Perry ordered Mitzie Begay released Monday because she isn’t listed as a witness in her husband’s ongoing trial.

Begay had invoked spousal privilege in refusing to be interviewed by prosecutors.

Her husband, Mel Begay, is charged with conspiracy to commit fraud, and making or permitting false tribal vouchers. He faces jail time, fines and the loss of his legislative seat if convicted.

Mitzie Begay’s attorneys had asked a federal court to find that the tribal courts unlawfully detained her. That request now is moot.
