PORTLAND, Maine (AP) – The Penobscot Nation and the federal government are appealing a federal court ruling that says the tribe’s reservation includes islands on the Penobscot River but the not the water.

The Portland Press Herald reports that the judge’s December 2015 ruling says the tribe can fish for sustenance from the river but could not charge people with violations of fishing regulations or water quality rules.

The tribe sued in 2012 saying its jurisdiction stretches from “bank to bank.”

An appeal notice was filed on Monday. It will be heard in a Boston federal appeals court.

Maine Attorney General Janet Mills and Chandler Woodcock with the state Department of Inland Fisheries and Wildlife are named as defendants in the appeal, along with Col. Joel Wilkinson of the Maine Warden Service.
